Default YouTube in violation of Adsense TOS

I blogged about this a few minutes ago and figured I would post it here as well.

This is what it says on the Google Adsense TOS page.

Copyrighted Material

In order to avoid associations with copyright claims, website publishers may not display Google ads on web pages with MP3, Video, News Groups, and Image Results.

That is probably what is going to happen. But, then again with YouTube being a part of google, it shouldn't be an issue for them.

If you really look into the statement, it says that Google doesn't want to display ads on pages with MP3, is because they too could be sued.
There won't be a "too" in case someone sues YouTube

Good point Ajay. But, it does beg the question as to why it wasn't an issue before Google made the buy.

I think no one wants to specify much or pay attention on that particular TOS thus not bringing any issue and besides no one is reporting sites with MP3 or video on them, all they want was the goods they will get.

I beg to differ. I actually had a page reported about two months ago because of an MP3 file. I think it was a competitor who reported the page, but either way Google made me remove the ad.

My $500.00 a month Adsense check must not be big enough...

Oh no, I have ads on a page with MP3s!

Does this TOS only apply to the specific page? Or, does it apply to the whole website with the MP3s just on one page?

I see pages with them all over the place so I imagine you have to be reported for them to take any real action.

Does Google just ask the violator to remove the violation or does Google sometimes ban them outright? Since this isn't an issue of click fraud, maybe they are more lenient.
